Privacy Policy for LeaseNote

 

This Privacy Policy is intended to describe how LeaseNote (a product brand of Jocova Financial Services Corporation) and its affiliates (“LeaseNote”, “we”, “us”, “our”, “vendors”, “dealers”, “finance company”, and “related parties”), collects, uses and discloses your business information and personal information.

 

To the Customer – Please read this Privacy Policy in Full. To summarize, LeaseNote, Dealers, Financing Companies, and anyone connected to us and our services wants to know and share as much information about your business and you personally as possible to get you approved for lease financing for equipment you have requested and need for your business. If you are not comfortable with this, please contact LeaseNote directly or the Dealer for alternative means of applying for lease financing.

 

The term “business information” means information that is defined to be “business information” in applicable Canadian privacy laws, such as information about an identifiable customer or commercial entity (also known as the “lessee” and/or “applicant”). It includes information that you provide or that we collect from other sources. As used in this Privacy Policy, the term “customer” or “commercial entity” (“also know as the “lessee” and/or “applicant”) refers to a business entity no matter what the structure or type (i.e. Incorporated, Sole Proprietorship, Partnership, etc.). “business information” and “personal information” are view as mutually exclusive when related to a commercial entity and for the purposes of using our services. The term “business information” and related information directly relates to “personal information” especially that of principals, owners, directors, partners, co-signors, and shareholders. See related “personal information” below for the use, collection, and management of this information.

 

The term “personal information” means information that is defined to be “personal information” in applicable Canadian privacy laws, such as information about an identifiable customer (also known as the “lessee” and/or “applicant”). It includes information that you provide or that we collect from other sources. As used in this Privacy Policy, the term “customer” (“also know as the “lessee” and/or “applicant”) refers to an individual person whom is a principle or shareholder of a business whose personal information we collect. Financial Institutions, Financial Entities, Lessors, Lenders, Brokers, Agents, Representatives, and Any Other Party Managing and/or Offering Financial Services (“Finance Company”)

LeaseNote makes no claim or warranty to the operation, management, or process of any Finance Company and we consider these to be third party links with their own privacy policies and practices in place for you to review and comply with. You should review any third party Privacy Policy and Terms and Conditions in full before engaging in any sort of relationship. It should be known that the Finance Company or entities are/should have a working relationship with the Dealer who’s site this LeaseNote application link originated from. Finance Companies may collect and use the minimum required information from customers (lessee’s, clients, applicants) and LeaseNote to process applications for equipment lease finance requests. Be aware that any Finance Company may require more information then that is collected via the online application and they may contact you as the customer (lessee / applicant) to obtain additional information, including paperwork or signatures necessary to process your application. No Finance Company is under any obligation to approval your application and it is up to their specific credit terms and conditions on how applications are reviewed and scored by each individual finance company. Applications for financing will be reviewed On Approved Credit basis and without predejust. Each Finance Company shall comply and treat customers (applicants / lessee’s) ethically and respectfully and in accordance with relevant law including for example Know Your Customer, Anti Money Laundering, etc. By providing a Finance Company with your information, you agree to the application disclaimer and how the information is used to obtain information to decision a credit application. LeaseNote further defines a Finance Company as any company whom we have a formal or informal relationship with which includes indirectly through Dealers that have signed-up with LeaseNote. The finance company is to understand that dealers may request and setup them up (the finance company) as part of their registration process which includes their financing partner details and they will be communicated with by the LeaseNote platform and be required to process applications for their dealer (vendors) behalf for interested customers requiring equipment lease financing. The dealer along with the finance company will need to adhere to our privacy policy and practices and if they disagree or fail to do so, they must be removed from the system and a general application will be put in place in the interim for the dealer. You also agree to the use of business information and personal information further laid out in this Privacy Policy.

 

Why We Collect, Use and Disclose Business Information & Personal Information

LeaseNote receives business information and personal information in the context of your application for the leasing or financing of an asset that LeaseNote or a dealer or vendor with whom we do business (“Dealer”) is offering to you via in-store or showroom, online, or at an arranged meeting location including your place of business (demo). LeaseNote may collect, use and disclose your business information and personal information for the purpose of providing application services, communications, data management, data aggregation, reports and hosting services on behalf of Dealers, our affiliates, and the finance company. Business information and personal information may be used by LeaseNote and disclosed to parties connect with the proposed transaction or actual leasing or financing, insurance, sale, assignment, or other disposal of all or part of LeaseNote or our business assets, or for the purposes of evaluating and/or performing any such proposed transaction. Assignees or successors of LeaseNote or our business or assets may collect, use and disclose your business information and/or personal information for similar purposes as those described in this Privacy Policy.

 

In addition to the above purposes, LeaseNote generally uses and discloses your business information and personal information for purposes of: maintaining business records for reasonable periods, reporting, and generally managing and administering our business; meeting legal, regulatory, insurance, security and processing requirements; and otherwise with your consent or as permitted or required by law. We may be required or permitted under statute or regulation to collect, use or disclose business or personal information without your consent, for example to comply with a court order or mandate, to comply with regulations or a legally permitted inquiry by a government agency, or to collect a debt owed to us.

Business Information & Personal Information We Collect

Business Information & Personal information we collect consists of business information & personal information: (i) that you provide to registered Dealer (in-store or online); when applying for financing or leasing of an asset, when evaluating an asset for purchase, or when Dealer uses any other service that LeaseNote provides to Dealer; and (ii) that is generated by Dealer in the course of providing services to you through its relationship with LeaseNote; or (iii) that you provide on our online application while applying for financing through a Dealer website linked to us. This information may include, but is not limited to: business legal name, business address, business registration number, articles of incorporation, years in business, use of equipment, industry, company ownership details, corporate tax return details, business address, business phone number, business owner personal name, address, telephone number and other personal contact information; credit and financial information; your Social Insurance Number (“SIN”) if you choose to provide your SIN – optional. We may otherwise collect business information and/or personal information with your consent or as permitted or required by law.

 

Service Providers

Business information & Personal information may also be transferred to, or accessible by, third party agents or service providers, including LeaseNote affiliates (collectively “Third Parties”) which we engage to provide data processing, storage or other services on our behalf. Some of the Third Parties or the services they provide may be located outside of Canada. We take reasonable measures to ensure that any of your business information & personal information that is collected, used, disclosed or otherwise processed by these Third Parties on our behalf is protected and not used or disclosed for purposes other than as directed by us, subject to legal requirements in foreign jurisdictions applicable to those organizations, such as lawful requirements to disclose business information & personal information to government authorities in those jurisdictions.

LeaseNote is committed to ensuring the compliance of this Privacy Policy is adhered to. Any questions with respect to this Privacy Policy should be directed to the contact details set out below with respect to the handling of all sensitive information.

LeaseNote does not control the privacy policies or practices of third parties (including, for example, Dealers) and, as such, any business information and/or personal information collected, used or disclosed by these parties is governed by their privacy policies and practices. You should review and make sure you understand the privacy policies of these third parties.

Consent

You, as the customer (applicant or lessee), provide your digital consent by completing any online application supported by LeaseNote by; a) reading the terms and conditions of the application disclaimer; b) providing accurate information to the related application questions; c) entering/typing in your name as the party that consents to the use of the information contained in the application; d) checking the authorization checkbox at the end of the application process to further confirm your consent to the application and use and sharing of the information within to all parties related to the potential transaction and as outlined in this Privacy Policy.

 

Accuracy

Customers and/or applicants must ensure that the business information & personal information provided to Dealer, the Finance Company and to LeaseNote is accurate, complete and up-to-date. Accuracy also includes that you are the correct/authorized person to be providing such information and provide your consent to do so.

Security

LeaseNote believes it employs reasonable physical, electronic, and organizational procedures to safeguard and help prevent unauthorized access of and to protect business information & personal information in its custody or control. Authorized employees and agents of LeaseNote will have access to your business information and personal information in so far as their duties require access.

 

 

Access, Correction, Retention, and Contacting LeaseNote

Dealer may establish and maintain a file of your business information & personal information for the purposes described above. You have the right to request access or correction to your business information & personal information. Requests for access or correction to your business information & personal information in the custody or control must be made in writing and be directed to the relevant Dealer. LeaseNote will provide you with contact information for Dealers for this purpose upon your request. Your business information & personal information in the custody or control of Dealer will be accessible as described in their respective public privacy policies or as otherwise described to you by Dealer.

For the purpose of providing communications and data management services and otherwise using/disclosing business information & personal information on behalf of Dealer as described in this Privacy Policy and in the Consent or other form of consent you provide, LeaseNote may retain your business information & personal information in an electronic or other file which will be accessible at your request per the contact details set out below. You may request access to, or correction of, your business information & personal information in our custody or control, by sending your request in writing to the LeaseNote Privacy Officer at the address set out below. Your rights of access and correction are subject to legal limitations.

Registered Dealers with LeaseNote

LeaseNote is committed to working with quality equipment re-sellers who’s core business is serving commercial businesses for their equipment needs. We may use information collected in the Dealer Registration process to verify said equipment Dealer(s) (aka “Vendors”, “Suppliers”) as a reputable and a known operation. Before granting services, LeaseNote, as part of our Dealer Registration and Due Diligence process may request additional information with respect to the Dealer and its operations. This information may include, but is not limited to legal name, address, phone, contact person, owner(s)/shareholders, business registration, and trade references. LeaseNote may also share any Dealer information with related third-parties such as service providers whom we have a relationship with. LeaseNote reserves the right to decline or suspend service with no reason to any Dealer, Vendor, Supplier. LeaseNote or our related companies may also from time to time contact dealers by email, telephone, fax, social media or otherwise. By registering with LeaseNote, you consent to this communication while we have an active business relationship together. Dealers of LeaseNote are to use customer information and our services respectfully and ethically and for the purposes outlined in this Privacy Policy. It is the responsibility of the Dealers, whom sign-up with LeaseNote, to notify any finance company or finance company contact who they are partnered with that they have been used in the dealer’s LeaseNote registration and informed about LeaseNote our services and how they will receive information and communication from LeaseNote and how they are expected to adhere to the Privacy Policy of LeaseNote. As a dealer signing up for LeaseNote services, you confirm you have consent from your finance company whom you have a relationship with to provide the contact details of your finance partner. Failure to do so could result in cancellation or suspension of services. LeaseNote expects that any finance company that has a relationship with a dealer, the finance company has done their due diligence when entering into a finance partnership with said dealer.

 

Changes to this Privacy Policy

This Privacy Policy may be revised from time to time. If we intend to use or disclose business information & personal information for purposes materially different than those described above, we will modify this Privacy Policy accordingly and post the revised version on our website in this section. Continued provision of business information & personal information to LeaseNote, to Dealers, and to Finance Companies that use LeaseNote’s services, or continued use of Dealers’ products or services that rely on LeaseNote services, following implementation of any change to this Privacy Policy constitutes your acceptance of this Policy as amended.
